AerialModel Privacy Policy

This Privacy Policy describes how Avenian LLC, doing business as AerialModel ("AerialModel," "we," "us," or "our"), handles information when you use AerialModel.com and related processing, storage, support and account services. It should be read with the AerialModel Terms and Policies.
Information We Collect
- Account and contact information: email address, account identifiers, authentication information, subscription status, support communications and preferences.
- Payment information: payment providers process payment-card details. We receive transaction, plan, billing-status and limited payment-method information needed to administer subscriptions and resolve payment issues.
- Project content: uploaded photos; EXIF/XMP and camera information; timestamps; GPS/GNSS, altitude, orientation and flight metadata; project names and settings; and generated maps, orthomosaics, GeoTIFFs, elevation products, point clouds, meshes, 3D models, previews and related outputs.
- AerialAlign information: when present, project-specific corrected or enhanced coordinates, transforms, accuracy estimates, confidence information, job identifiers and other integration metadata. Third-party reference imagery or source layers remain subject to their own licenses.
- Service and device information: IP address, browser and device information, request and security logs, pages and features used, upload and processing events, error reports, cookies and similar operational data.
- Approximate and project location: location inferred from network information and precise locations contained in user-provided project imagery or metadata.
How We Use Information
- Provide accounts, uploads, processing, storage, previews, downloads, collaboration, support and subscriptions.
- Authenticate users; maintain project ownership and permissions; prevent fraud, abuse and security incidents; diagnose errors; and enforce plan and technical limits.
- Operate, maintain, measure and improve AerialModel, including reliability, workflows, processing quality and service capacity.
- Comply with law, respond to lawful requests, enforce agreements, protect rights and safety, and resolve disputes.
- Use and commercialize opted-in project data as specifically described under Licensed Project Data.
Ordinary Project Data and Public Projects
We do not treat every upload as commercially licensed dataset inventory. Private-project content is used to provide, secure and support the service and for other uses you separately authorize. Public projects may be displayed and indexed as described in the Model Visibility Policy, and AerialModel receives the limited public-display and promotional license stated there. Making a project public is not the same as joining the optional dataset program.
Licensed Project Data — Optional Dataset Commercialization Program
A project enters this program only when the authenticated account holder affirmatively checks the dedicated Optional Dataset Commercialization License box for that project. New projects are not pre-enrolled. The choice is separate from whether the project appears in AerialModel's public listings and does not create a public badge or public permission label. Licensed Project Data may nevertheless be delivered, licensed, published or sold to dataset recipients as described below.
For an opted-in project, we may retain, analyze, validate, correct, transform, annotate, de-identify, combine, create derivatives from, distribute, license, sublicense and sell the uploaded source imagery, associated technical metadata and generated outputs. This may include orthomosaics and GeoTIFFs; tiles and previews; DSM/DTM and other elevation products; LAS/LAZ and other point clouds; OBJ models, materials and textures; camera poses and reconstruction information; and project-specific AerialAlign corrections, transforms and accuracy metadata that we are legally and contractually permitted to distribute. Uses and recipients may include AerialDataset.com, AI/ML developers, computer-vision and robotics companies, geospatial and mapping organizations, researchers, educational institutions, data marketplaces, customers, licensees and resellers.
Dataset packages will not include account email addresses, authentication credentials, payment or billing records, support communications, or our internal consent audit records. We may remove or replace project names, account-linked identifiers and other administrative labels with internal dataset identifiers. Third-party reference imagery, maps, basemaps and source layers are excluded unless we independently have the right to redistribute them. These exclusions do not prevent us from retaining administrative and audit information to operate the service, document permission and comply with law.
We internally record whether the project was authorized, the license version, UTC acceptance time, acceptance source, authenticated account and project identifier. A future AerialDataset integration can use these internal fields to select only authorized projects. These fields are not included in AerialModel's public project responses.
Before processing begins, the uploader may withdraw the project by unchecking the option and remaining within the standard processing allowance. After processing begins, the content-license consequences are governed by the Optional Dataset Commercialization License. Applicable privacy laws may provide separate, nonwaivable rights over personal information. An uploader's permission does not eliminate rights held by identifiable people or other data subjects whose information appears in the imagery.
How We Disclose Information
Depending on the service and choices made, information may be disclosed to:
- Service providers: cloud hosting, object storage, processing, email, payments, analytics, security, support and technical vendors working for us.
- Collaborators and the public: people invited to a project, and visitors or search engines when the user makes a project public.
- Dataset recipients: for opted-in projects only, customers, researchers, AI/ML and geospatial developers, licensees, sublicensees, marketplaces, distributors and resellers permitted by the optional license.
- Legal and safety recipients: regulators, courts, law enforcement, counterparties and advisers when reasonably necessary to comply with law or protect rights, security and safety.
- Corporate transactions: an acquirer, successor, affiliate, investor or adviser involved in a merger, financing, sale, reorganization or transfer of all or part of the business, subject to applicable law.
Retention and Deletion
We retain information for as long as reasonably necessary for the purposes described here, including providing the service, maintaining security and backups, meeting legal and accounting duties, resolving disputes and enforcing agreements. Ordinary deleted project data is handled under the deletion and backup periods stated in the Model Visibility Policy, subject to legal holds and technical limitations.
For opted-in Licensed Project Data, deletion of the user-facing project may not delete archival copies, derivatives, combined datasets, copies already delivered to licensees, or records needed to document the license, except where applicable law requires otherwise. Downstream recipients may retain data under licenses granted before a request.
Your Choices and Privacy Rights
- You can choose project visibility where your plan supports it and can decline the optional dataset license without losing your ordinary plan allowance.
- You can stop enrolling future projects by leaving the optional checkbox unchecked.
- You may request access, correction or deletion of certain account information by contacting us. We may need to verify your identity and may retain information where permitted or required by law.
- Residents of jurisdictions with additional privacy rights may request the rights available to them, including, where applicable, rights concerning access, correction, deletion, portability, restriction, objection, consent withdrawal, or opt-out of legally defined sale, sharing or targeted advertising.
Send requests to support@aerialmodel.com with the subject "Privacy Request." Include enough information to identify the account and project. We will not discriminate against a person for exercising a nonwaivable privacy right, although deleting data needed for a requested service may affect our ability to provide that service.
Security
We use administrative, technical and organizational safeguards designed to protect information. No network, storage system or transmission method is completely secure, so we cannot guarantee absolute security. Users are responsible for maintaining account credentials and for using appropriate project visibility and sharing settings.
Children
AerialModel is not directed to children under 13, and the optional dataset program is available only to adults with authority to grant the required rights. Do not upload or commercialize data primarily concerning children without all legally required authorization.
International Use
AerialModel is operated from the United States. Information may be processed in the United States and other locations where our providers or authorized dataset recipients operate, subject to applicable transfer requirements.
Changes to This Policy
We may update this policy prospectively. We will post the revised date and provide additional notice or obtain renewed consent when required. We will not silently apply a materially expanded optional dataset license to existing projects that did not affirmatively join the program.
